Terms of Service

These Terms of Service ("Terms") govern your use of the Roamful website, maps, and related services (the "Service"), operated by Studypop LLC, a Massachusetts limited liability company ("Roamful", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Please read Section 13 carefully. It contains a binding arbitration clause and a class action waiver that affect your legal rights, including your right to bring a claim in court. You may opt out of arbitration within 30 days (see Section 13d).

1. What Roamful is

Roamful is an informational "know before you go" service for outdoor places. It brings together publicly available information about beaches, parks, ponds, lakes, and similar sites, including status, parking, access, and cost. It is a convenience and planning aid, not an official or authoritative source. Roamful is not available to children under 13.

2. Accuracy and no warranty

We work to keep information useful, but we cannot guarantee it is accurate, complete, current, or applicable to your situation. Conditions change, sources go out of date, and some details are estimated or unconfirmed. Beach water-quality status reflects each beach's latest Massachusetts DPH posting; the DPH dashboard is the authority. Access, parking, hours, and cost come from public town and agency pages and may be wrong or outdated.

Always confirm locally before you go.

3. Your responsibility and assumption of risk

Spending time outdoors carries inherent risks. You are responsible for your own safety and your decisions, including checking official rules, closures, tides, weather, and whether a place is open to the public and to you. You agree to follow all posted rules and laws. You use the Service and act on its information at your own risk.

4. Accounts

Some features require an account. You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. Notify us at hello@roamful.io if you suspect unauthorized access. We may suspend or terminate access that violates these Terms or that we reasonably believe is harmful or unauthorized.

5. Your submissions

If you submit content such as feedback, edits, tips, or photos ("User Content"), you keep any rights you have in it and grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, and adapt it to operate and improve the Service. You represent that you own or have the right to share the content, that it does not infringe anyone's rights, and that you have the right to grant this license. Do not submit anything confidential or anything you do not have the right to share.

If you send us suggestions or ideas about the Service, you grant us an unrestricted, perpetual, royalty-free right to use them for any purpose without obligation to you.

6. Acceptable use

You agree not to:

Access to non-public portal data is limited to authorized account holders. We may remove content and suspend or terminate accounts that violate these rules.

7. Intellectual property

The Service, including its design, text, and compiled data, is owned by Roamful or its licensors and is protected by applicable law. These Terms do not grant you any right to use our name, logo, or branding. Underlying open and public data remains subject to its own sources and licenses (for example OpenStreetMap contributors, Massachusetts DPH, MassGIS, and NOAA), which we credit where used.

8. Third-party sources and links

The Service relies on and links to third-party sources and sites. We do not control them and are not responsible for their content, availability, or accuracy, and linking does not imply endorsement.

9. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to hello@roamful.io with the subject line "DMCA". To be effective, your notice should comply with 17 U.S.C. § 512(c)(3), including identification of the copyrighted work and the allegedly infringing material, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act for the copyright owner. We will remove infringing content and, in appropriate cases, terminate repeat infringers.

10. Disclaimers of warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ITS INFORMATION IS ACCURATE, COMPLETE, OR RELIABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAMFUL AND STUDYPOP LLC, AND THEIR OWNERS, EMPLOYEES, AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE, INCLUDING INACCURATE INFORMATION, A CLOSED OR RESTRICTED SITE, A PARKING CITATION, INJURY, OR PROPERTY LOSS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages. They are an essential part of the basis of the bargain between you and us. Some jurisdictions do not allow certain limitations, in which case our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Roamful and Studypop LLC, and their owners, employees, and agents, from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Dispute resolution

13a. Informal resolution first

Before filing any formal claim, you agree to contact us at hello@roamful.io and try to resolve the dispute informally for at least 30 days.

13b. Binding arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR TO HAVE A JURY HEAR YOUR CLAIMS.

If we cannot resolve a dispute informally, you and Roamful agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will be conducted in English, and any in-person hearing will take place in Massachusetts. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Exceptions: either party may bring an individual claim in small claims court, may seek emergency injunctive relief in court to preserve the status quo, and may bring intellectual-property claims in court without first arbitrating.

13c. Class action and jury trial waiver

YOU AND ROAMFUL AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. YOU AND ROAMFUL WAIVE ANY RIGHT TO A JURY TRIAL.

If this class action waiver is found unenforceable, the arbitration provision in this Section 13 is null and void and the dispute will proceed in court.

13d. Opt-out

You may opt out of this arbitration provision by emailing hello@roamful.io within 30 days of first accepting these Terms, with your name, the email associated with your use of the Service, and a clear statement that you wish to opt out of arbitration.

13e. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be brought in the state or federal courts located in Massachusetts.

14. Changes

We may change the Service or these Terms at any time. Material changes take effect when we post the updated Terms with a new effective date. Continuing to use the Service after that means you accept the changes. If you do not agree, stop using the Service.
